EVENT HOST LIABILITY WAIVER & RESPONSIBILITY AGREEMENT

This Event Host Liability Waiver & Responsibility Agreement (“Agreement”) is entered into between the undersigned Event Host (“Host”) and Foam Frenzy Co.​

 

HOST RESPONSIBILITY ACKNOWLEDGMENT

By signing this Agreement, I acknowledge and agree that I am the responsible party hosting the event and accepting responsibility for the event location, attendees, and general safety of all guests participating in activities provided by Foam Frenzy Co.

I understand that foam party activities involve inherent risks including, but not limited to:

• Slipping or falling on wet surfaces

• Physical activity injuries

• Participant collisions

• Water-related hazards

• Injuries resulting from improper supervision or unsafe behavior​

 

ASSUMPTION OF LIABILITY FOR ATTENDEES

I acknowledge and agree that:

• I am responsible for communicating safety rules to all attendees.

• I will ensure appropriate adult supervision for minors at all times.

• I accept responsibility for guests attending the event, including invited participants and spectators.

• I understand that Foam Frenzy Co does not supervise children or monitor individual participant behavior.

I further agree that I assume liability for injuries, damages, or claims arising from attendees’ actions, behavior, or failure to follow safety instructions during the event.​

 

SAFE EVENT AREA AGREEMENT

I certify that the event area provided is reasonably safe for foam activities and free from known dangerous hazards including, but not limited to:

• Sharp objects

• Unsafe surfaces

• Animal waste

• Debris or obstacles

• Electrical hazards

I understand that foam surfaces become slippery and agree to help maintain a safe environment during the event.

CLIENT RESPONSIBILITIES & EVENT AREA REQUIREMENTS

I acknowledge and agree to provide the following:

• Adequate access to a working water source

• A standard electrical power outlet

• A safe, flat outdoor setup area for the duration of the event.

• Ensure the event space is free and clear of sharp objects, pet waste, debris, holes, or any other potential hazards that could cause injury or interfere with equipment operation.

• Responsible adult supervision of all participating children at all times during the event.

Failure to provide appropriate setup conditions or supervision may result in suspension or termination of services without refund if deemed unsafe by Foam Frenzy Co..

RELEASE OF LIABILITY

In consideration for services provided by Foam Frenzy Co, I hereby release, waive, and discharge Foam Frenzy Co, its owners, employees, contractors, and affiliates from any and all claims, liabilities, damages, expenses, or causes of action arising out of or related to:

• Injuries to attendees or spectators

• Property damage occurring during the event

• Participant conduct or misuse of equipment

• Failure of attendees to follow safety instructions

except in cases of gross negligence or intentional misconduct by Foam Frenzy Co.​

 

INDEMNIFICATION

I agree to indemnify and hold harmless Foam Frenzy Co from and against any claims, lawsuits, damages, attorney fees, or expenses arising from the actions of attendees, unsafe conditions at the event location, or violations of this Agreement by the Host or attendees.

 

WEATHER & EVENT CONDITIONS

I understand that outdoor conditions may impact event safety. Foam Frenzy Co. reserves the right to pause or stop services due to unsafe weather or unsafe conditions. In the event of severe weather, parties may be rescheduled based on availability.

CANCELLATION POLICY

By booking with Foam Frenzy Co, I understand and agree that cancellations must be made at least 24 hours prior to the scheduled event start time in order to receive a full refund. Cancellations made less than 24 hours before the scheduled event start time are non-refundable.​

AGREEMENT

I have read and fully understand this Event Host Liability Waiver & Responsibility Agreement. I voluntarily agree to all terms and conditions stated above.
